Welcome to MyGavel™ ("App"). By creating an account, accessing, or using this App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Agreement"). If you do not agree to these Terms, do not use the App.

1. Purpose of the App

MyGavel™ is a document preparation assistance platform designed to help self-represented individuals organize information and generate legal document drafts based upon information provided by the user.

The App is an informational and document preparation tool only.

The App does not provide legal advice, legal representation, legal strategy, legal opinions, or attorney-client services.

2. No Attorney-Client Relationship

Your use of this App does not create an attorney-client relationship with MyGavel™, its owners, developers, designers, affiliates, employees, contractors, licensors, or consultants.

No communication with the App shall be construed as legal advice.

Nothing generated by the App should be interpreted as advice regarding your legal rights or obligations.

3. Not a Law Firm

MyGavel™ is not a law firm.

The App is not a substitute for consultation with a licensed attorney.

The App is not engaged in the practice of law.

The App does not appear in court, represent litigants, negotiate legal matters, or provide legal opinions.

4. Informational Purposes Only

All content produced by the App is provided solely for educational and informational purposes.

Any forms, pleadings, motions, declarations, correspondence, or other documents generated by the App are templates created from user-provided information and publicly available legal formatting concepts.

Generated documents are drafts only.

5. User Responsibility

The user is solely responsible for entering accurate information, reviewing every generated document, verifying all factual statements and legal citations, verifying formatting requirements, confirming compliance with local court rules and state laws, confirming deadlines and filing procedures, and making any necessary corrections.

The user must independently review every document before signing, serving, filing, or relying upon it.

The App makes no representation that any generated document is complete, accurate, legally sufficient, current, or appropriate for the user's specific legal matter.

6. No Guarantee of Legal Outcome

MyGavel™ does not guarantee success in litigation, favorable rulings, acceptance by any court or government agency, legal accuracy or completeness, or compliance with procedural rules or local court requirements.

Every court, judge, jurisdiction, and legal matter is different. Past results or generated documents are not predictive of future outcomes.

7. User Acknowledgement

By using this App, you expressly acknowledge that you are solely responsible for every document you choose to sign, submit, file, serve, mail, email, upload, or otherwise use; that legal proceedings involve substantial rights and obligations; that legal documents may require revision based upon court rules, statutes, local rules, judicial preferences, or changing law; and that you agree to independently verify every document before relying upon it.

8. Independent Review Required

Prior to filing any document with any court or governmental agency, the user agrees to read the entire document and verify every factual statement, name, date, exhibit reference, legal citation, statutory reference, procedural step, and court-specific formatting requirement.

Failure to perform this independent review is solely the responsibility of the user.

9. No Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MyGavel™, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, DEVELOPERS, DESIGNERS, CONTRACTORS, CONSULTANTS, AFFILIATES, SUCCESSORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST INCOME OR CLAIMS; DISMISSED CASES; SANCTIONS; ATTORNEY FEES; FILING ERRORS; MISSED DEADLINES; ADVERSE COURT RULINGS; JUDICIAL DECISIONS; LITIGATION EXPENSES; EMOTIONAL DISTRESS; RELIANCE DAMAGES; OR ANY OTHER LOSSES ARISING FROM OR RELATING TO USE OF THE APP.

10. User Assumes All Risk

The user voluntarily assumes all risks associated with document preparation, legal filings, court procedures, litigation strategy, and reliance on generated content. The user acknowledges that use of the App is entirely at their own risk.

11. Limitation of Liability

If any claim is permitted despite the foregoing limitations, the total aggregate liability of MyGavel™ shall not exceed the total amount actually paid by the user for use of the App during the twelve (12) months preceding the claim.

If the App was used free of charge, the maximum liability shall be One Dollar ($1.00), to the extent permitted by applicable law.

12. Indemnification

The user agrees to indemnify, defend, and hold harmless MyGavel™, its owners, developers, affiliates, employees, contractors, licensors, successors, and assigns from any claims, liabilities, damages, judgments, costs, expenses, or attorney fees arising out of the user's use or misuse of the App, documents created by the user, court filings made by the user, violations of law, or violations of these Terms.

13. Accuracy of User Information

The App relies entirely upon information entered by the user. MyGavel™ is not responsible for incomplete, inaccurate, or misleading information; omitted facts; typographical errors; incorrect dates; or incorrect legal descriptions.

14. Changes in Law

Laws, procedural rules, statutes, court rules, filing requirements, and judicial interpretations change frequently.

The App does not warrant that generated documents reflect the most current law applicable in every jurisdiction. Users are responsible for confirming current legal requirements before relying upon any document.

15. Intellectual Property

All software, design, branding, algorithms, interfaces, graphics, trademarks, text, and source code remain the exclusive property of MyGavel™ unless otherwise stated. Users receive only a limited, revocable, non-exclusive license to use the App in accordance with these Terms.

16. Termination

MyGavel™ reserves the right to suspend or terminate any account for misuse, fraudulent activity, abuse, unlawful conduct, or violation of these Terms.

17. Privacy

Use of the App is also governed by the Privacy Policy. Users should not upload confidential or sensitive information unless they understand and accept the associated risks described in the Privacy Policy.

18. Governing Law

This Agreement shall be governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located within California, unless applicable law requires otherwise.

19. Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between the user and MyGavel™ regarding use of the App.

21. Acceptance of Terms

By creating an account, clicking "I Agree," or using the App, the user acknowledges and agrees that: they have read these Terms in their entirety; they understand that the App does not provide legal advice; they understand the App is not a law firm; they are solely responsible for reviewing and verifying every generated document; they accept full responsibility for all court filings and legal decisions; they understand that no legal outcome is guaranteed; and they agree to these Terms and Conditions.
